shouldnt this be illegal because i remember i was watching EliteXC rules along with Refree Herb Dean explaning rules and he said they shouldnt manuever opponet like that... i mean if this is possible then wouldnt a Pile Driver should be legal as well? and it could break one's neck in half

Ive actually seen this submission work once also in Japan. He should have gotten hold of the legs of his opponent and tried to keep him grounded. And when he was lifted he should have released of course.

Yeah, and so should fighting with your chin up and your hands down because you can get knocked out more easily and it could be painful!
Perhaps if you add enough rules you can just call it CHESS, oh, that's right...we already have that contest of wits with no fists.
Heck, I'll go in the complete opposite direction and say they should allow knees and kicks to the head of a downed opponent! And when Wandy blasts some dude in the face with soccer kick and knocks him out...Joe Rogan can do his best impression of the Euro Futbol announcer yelling..."Goooooooooaaal!"

Rules are different in every organisation, as you should have noticed it wasn't an EliteXC fight.
Out in the east the rules are more open to more dangerous moves such as head stomps, spikes, knees to the head of a grounded opponent etc.
Yes it's dangerous to do that, but isn't being punched and kicked in the head and choked out dangerous too? There are certain degrees of danger and alot of rules have stamped out the most dangerous ones. I nthis match spiking opponenets into the ground is allowed... ouch.
The difference between this and the pile driver is that the guy on the bottom could have let go. In the pile driver the aggressor has control and the victim is more or less powerless to get away.

hmm this is Between Legal and Illegal
invert a opponent in middle air and slam in the head is Illegal basically everywhere and most of the submission apply to spine,so in that way this was Illegal but the guy wasn't totally invert even if the damaged was applied to the spine.
do anyone know how this ended?
hmm im not sure if the Referee is nullify or giving the fight.
He probably didn't know what to do. For the life of me I can't figure out why he didn't let go. Maybe he was saving his hands by absorbing the impact with his face, but that makes little sense to me.
